Hardship Case Exemption
When your income isn’t enough to cover reasonable living expenses and/or afford necessary financial expenses such as utilities, rent and council tax or those struggling to repay debts such as mortgage arrears or heavy credit card debts.
Lack of funds
FSA GUIDELINES – Are items repeatedly being returned unpaid due to lack of funds?
OUR INTERPRETATION – If you don’t have enough money in your bank account to meet things like utility bills and other payments, so that things regularly bounce.
Failing to pay?
FSA GUIDELINES – Are you failing to make loan repayments or other commitments?
OUR INTERPRETATION – Like the lack of funds note above yet here where it affects mortgage, loan or credit card repayments.
Money no longer coming in?
FSA GUIDELINES - Is there a discontinuation of regular credits.
OUR INTERPRETATION - This needs some clarification but we interpret it as some or all of your regular income/salary is no longer being paid to you.
Insolvency Proceedings?

OUR INTERPRETATION – Are you involved in going bankrupt or entering into an IVA.
Borrowing increases?
FSA GUIDELINES – Are there regular requests for increased borrowing or repeated rescheduling of debts.
OUR INTERPRETATION – Are you living off credit cards and struggling to repay it or continuing to borrow as your lifestyle isn’t sustainable due to debts.
Do you withdraw cash on a credit card?
FSA GUIDELINES – Do you make regular withdrawals on a credit card at a non-promotional rate of interest.
OUR INTERPRETATION – Credit card cash withdrawal are a major problem. The interest rate charged is usually much higher than just spending on the card.
Do you continue to regularly go beyond your overdraft limit?
FSA GUIDELINES – Do you repeatedly exceed your credit card or overdraft limit without agreement (and, in the regard, where a complaint has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).
OUR INTERPRETATION – If you are getting over £500 per year in bank charges, then almost by definition your in financial hardship. Many people with big claims will be exactly in this boat.
